This program of work is focused on lowering regulatory compliance cost to businesses in the horticulture value chain through support to addressing Blueprint identified regulatory and administrative barriers impacting competitiveness and investment specifically: i. Supporting the simplification of the importation and registration process for Biological Control Agents (BCAs). ii. Supporting simplification of the importation, registration and licensing of pesticides especially related to the time and cost imposed on businesses. FIRM PROFILE The consultant will be a firm. Provide information on the qualifications of key staff. 1 Tanzania Business Enabling Environment Support Program Terms of Reference The International Finance Corporation-s (IFC) Creating Markets Advisory (CMA)is seeking to hire consultancy firm to provide support to address Blueprint identified regulatory and administrative barriers to the horticulture sectorin the context of the CMAteam-s investment climate advisory services program in Tanzania. I. Project Background The International Finance Corporation(IFC) is supporting implementation of Business Enabling Environment (BEE) reforms in Tanzania. Building upon an earlier advisory program (i.e., ICAS I), the BEES program is a five-year, US$7 million program aimed at supporting the Government of Tanzania (GoT) to promote sustainable and inclusive economic growth through better economic foundation, an improved regulatory environment and lower costs to businesses. The program targets economy-wide reform though improved business licensing and sector specific reformsin the Agribusiness and Textile space. II. Objective of the Assignment This assignment focuses on the Agribusiness component of the BEES program, which is designed to support the GoT-s Agriculture Sector Development Program (ASDP I&II). Based on extensive consultations with relevant stakeholders, the Agribusiness sub-component aims at lowering regulatory compliance cost to actors in the horticulture value chain through support to address Blueprint identified regulatory and administrative barriers impacting competitiveness and investment to the horticulture sector, specifically : a. Support simplification of the registration process for Biological Control Agents (BCAs). The importation and registration process for newer, safer products is unclear, excessively long and discourages access to modern or better-quality products. b. Support simplification of the importation, registration and licensing of pesticides especially related to the time and cost imposed on businesses. Work will focus on pesticides that have already been trialed in accredited laboratories and registered in comparable neighboring countries. III. Scope of work The Plant Health Service (PHS), a unit in the Ministry of Agriculture, and the Tropical Pesticide Research Institute (TPRI) are both involved in inspection activities, issuing import permits for plant and plant products, and phytosanitary certificates for exports; which results into duplicative functions and make coordination difficult. Furthermore, the TPRI is in charge of pesticide registration and import quarantine services, while the PHS is responsible for managing pest outbreaks - an inherent disconnect in pest control. Overall, the overlapping and 2 related mandates and regulatory responsibilities have increased cost, discouraged compliance, contributed to lower productivity and disincentivized investment in the sector. Cognizant of these challenges, the GoT established the Tanzania Plant Health and Pesticide Authority (TPHPA) at the Ministry of Agriculture (MoA) that will, amongst other things, address the harmonization of the duplicative roles and responsibilities of TPRI and PHS. The consultant firm will thus work with the MoA to identify and recommend opportunities to low business cost compliance, improve operational efficient and advance reform specific to the regulatory process and compliance requirement for Biological Control Agents(BCAs) and Pesticides. Specifically, the Firm is expected to undertake the following: 1) A rapid review of processes and compliance requirements impacting how agribusiness import, access, and use of BCA and Pesticides in order to project potential cost savings and reform opportunities. 2) Make recommendations on actions and reforms that simplify process and compliance for businesses in the import, registration and supply of BCA and Pesticides including: a. Key regulatory and admin barriers to importation of BCA and Pesticides b. Key regulatory and admin barriers to licensing and inspections relevant to BCA and Pesticides c. Tax and fees related to BCA and Pesticides 3) Support the drafting of regulations, guidelines, SOPs that facilitate reform recommendations. 4) Support TPHPA in the submission of proposed reforms to the Min. of Agriculture for endorsement and adoption 5) Support TPHPA with training to support enforcement of new regulations and protocols. 6) Coordination of stakeholders in the BCA and Pesticide value chains to facilitate input on potentially proposed reforms and feedback to government on issues faced by businesses working in these VCs. 7) Review the Plant Protection Act and the Tropical Pesticides Research Institute Act and make recommendations and otherwise harmonization of the two Acts. 3 IV. Expected Deliverables 1) Inception report providing clear methodology and workplan for undertaking the assignment 2) Report and PowerPoint deck identifying compliance costs savings and reforms that are potentially available to TPHPA. This report will detail the potentially simplified and less expensive regulatory process/protocols impacting importation, registration and supply of BCAs and pesticides that are possible though reform. 3) At least 3 reports detailing the impact and implications the regulations/guidelines/SOPs developed will have towards the regulatory process. 4) Short overview of Key Recommendation for reform. This can be an annex to #2 5) Hold at least 3 stakeholder coordination/validation meetings and summary of key conclusions 6) Hold at least 4 trainings to TPHPA team. 7) Training materials and protocols to support enforcement of the new regulations and protocols for Ministry of Agriculture/TPHPA staff involved in regulating the importation and registration of BCAs and pesticides in the country. V. Selection Criteria The firm should have extensive experience in designing and implementing agriculture policy related reforms.
